Terms of Service

These terms govern your use of Mailsweeper (the “Service”), the macOS app and the cloud-mode service at mailsweeper.cbsrv2.net operated by Stoerkens GmbH, Karl-Birzer-Str. 7, 85521 Ottobrunn, Germany (the “Provider”, “we”, “us”). By installing the Mac app or signing in to the cloud service, you accept these terms.

1. The Service

Mailsweeper helps you triage email by polling your mail accounts and applying rules you author. The Mac app runs in local mode on your Mac without our involvement. The optional cloud mode moves polling to our server so it continues without your Mac being awake; cloud mode requires a Pro subscription.

3. Subscriptions, billing, renewal

Pro subscriptions are processed by Stripe. By subscribing you authorize Stripe to charge your chosen payment method. Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.

You can cancel any time from the Manage Subscription portal in Settings → Cloud Sync, or by emailing andreas.stoll@stoerkens.de. After cancellation your subscription remains active through the end of the current billing period; cloud mode then becomes read-only and the server stops polling.

14-day refund. If you’re unhappy with the Service for any reason, email andreas.stoll@stoerkens.de within 14 days of your initial purchase or any renewal and we’ll refund you in full, no questions asked.

Statutory rights of withdrawal under §§312g, 355 BGB remain unaffected.

The Pro plan limits the number of mail accounts per user (currently 10). We reserve the right to throttle, suspend, or terminate accounts that we reasonably believe are abusive — for example accounts running degenerate rules, sustained API overuse, or attempted resale of the Service.

6. Service availability

We aim for the Service to be available, but we do not guarantee uninterrupted service. Polling cadence may slow during incidents; if it stops entirely you’ll see a “Needs reconnect” or sync-error indicator in the Mac app. Critical maintenance is announced in advance when possible.

7. Your data

How we handle your data is governed by our Privacy Policy, which forms part of these terms. Briefly: we never read your mail beyond what your rules need, never share data with third parties beyond the named sub-processors, and you can delete your account any time.

8. Intellectual property

The Mac app and server software are © 2026 Stoerkens GmbH. The app is distributed for personal use; redistribution of the binary is allowed via the official download URL only. Source code, where shared publicly, is governed by its respective license.

9. Termination

You can stop using the Service at any time by quitting the app and (if applicable) emailing us to delete your account. We may terminate or suspend your access for material breach of these terms or as required by law; we will refund any remaining prepaid period unless termination is for abuse.

10. Disclaimer of warranties

The Service is provided “as is”. We make no warranties that it will be error-free, uninterrupted, or perfectly correct in every rule it applies. You are responsible for reviewing the Auto-moved log and confirming no important mail was misclassified. Mailsweeper provides a Restore action; use it.

11. Limitation of liability

To the extent permitted by German and EU law, the Provider is not liable for indirect or consequential damages arising from use of the Service. Liability for damage to life, body, or health and for damages caused intentionally or by gross negligence remains unaffected.

12. Changes to terms

We may update these terms. Material changes will be announced in-app or by email. Continued use of the Service after the effective date of new terms constitutes acceptance.

13. Governing law and venue

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules in your country of residence remain unaffected. Place of jurisdiction for merchants is Munich, Germany.
